Friends, can you imagine

that some batteries claiming to be from Apple or Huawei

actually come from a shabby workshop of just over 30 square meters?

Although they look like “big brands,”

they lack key protective devices.

Buying these inferior batteries

is like having a “time bomb” right next to you.

Recently, the People’s Procuratorate of Hongkou District

disclosed a case of

production and sale of counterfeit mobile phone batteries,

with illegal business dealings amounting to several million yuan.

Three people were sentenced!

Defendant Xu Mouquan registered and opened two online stores early on, engaging in wholesale battery sales. In 2023, he met Xu Mougang, who runs a battery factory, and started purchasing raw materials and parts himself, asking Xu Mougang to help with OEM and labeling.

During the trial, Xu Mougang stated that his job was to assemble the raw materials of the batteries. His brief answers revealed the true manufacturing process of these “branded batteries.”

“Is there a national standard for assembly operations?”

“No.”

“Are the personnel qualified?”

“No.”

“Is there a factory inspection before delivery?”

“No.”

According to investigations, Xu Mougang operated three workshops: one for production, one for silk-screen printing of trademarks, and one for storage. He recruited some villagers from his hometown and his own brothers to participate in the production of counterfeit battery trademarks.

The batteries assembled in the workshops were then sent to Xu Mouhua’s labeling workshop for labeling, and then supplied externally. During the trial, Xu Mouhua said that he printed trademarks of brands like Apple, Huawei, and Xiaomi.

Appraisals showed that some counterfeit branded batteries had overcurrent charging protection that did not meet safety standards, indicating they were substandard products. Police investigations found that Xu Mouquan’s two online stores sold counterfeit Apple batteries worth over 910,000 yuan. Additionally, 15,000 counterfeit Apple batteries worth 340,000 yuan were seized at Xu Mouquan’s home. The total illegal business amount exceeded 1.2 million yuan. Xu Mougang and Xu Mouhua also sold batteries with labels of other brands like Huawei and Xiaomi, with illegal sales totaling about 1.3 million yuan.

Assistant Prosecutor Chen Dongdong stated,

"The counterfeit batteries sold in this case

cost only a few dozen yuan at production price,

and the profit margin for several defendants

generally ranges from 20% to 30%."

The Hongkou District People’s Procuratorate prosecuted the three for trademark infringement, and also conducted civil public interest litigation to address the infringement of the rights of unspecified consumers. They demanded that the defendants publish warning notices and apology statements in national media.

Shanghai Hongkou District People’s Procuratorate Prosecutor Zhang Tingting said,

"Appraisals confirmed that these batteries

lack overcurrent protection devices,

which can lead to risks of explosion, swelling, or leakage during charging."

Ultimately, the Hongkou District People’s Court

sentenced Xu Mouquan, Xu Mougang, and Xu Mouhua

to prison terms ranging from 1 year and 6 months to 3 years,

and fined them between 60,000 and 250,000 yuan,

all with suspended sentences.

Prosecutors remind consumers,

"Because these involved mobile phone batteries are small and often enclosed inside phones, they are highly concealed, making it easier for consumers to overlook safety risks.

When purchasing electronic products, especially lithium batteries, always buy from正规 stores and platforms. Pay particular attention to significant price differences between sales channels and official prices. If such discrepancies occur, verify the source and authorization of the products to protect your legal rights."
